i am not sure which company it is but one owns the copyright on the
'happy birthday' song
they collected royalties on films containing the song until recently

I love it. I guess we could get around it by using some delimiters
other than < > between the elements of string data and then associating
this tag-delimited data with some sort of dictionary that handles the
element names ...

Or maybe that would be included in the 1997 patent too?

Read the patent details as laid out in USPTO. Both patents distinctly
talk about a non-hierarchical method of storing, transfering or
modelling data.

As we very well know XML is strictly hierarchical.

With a patent the crunch comes in interpreting the claims text rather
than the supporting text (which sets the stage so to speak). As a
programmer rather than a patent lawyer it is difficult for to accurately
interpret the claims.

My humble opinion is that this company would have difficulty in trying
to enforce payment of royalties from these patents against XML.

Just my opinion.
